WASHINGTON  Democratic presidential candidate Barack Obama was less than upfront in his half-hour commercial Wednesday night about the costs of his programs and the crushing budget pressures he would face in office.

Obamas assertion that Ive offered spending cuts above and beyond the expense of his promises is accepted only by his partisans. His vow to save money by eliminating programs that dont work masks his failure throughout the campaign to specify what those programs are beyond the withdrawal of troops from Iraq.

A sampling of what voters heard in the ad, and what he didnt tell them:

THE SPIN: Thats why my health care plan includes improving information technology, requires coverage for preventive care and pre-existing conditions and lowers health care costs for the typical family by $2,500 a year.

THE FACTS: His plan does not lower premiums by $2,500, or any set amount. Obama hopes that by spending $50 billion over five years on electronic medical records and by improving access to proven disease management programs, among other steps, consumers will end up saving money. He uses an optimistic analysis to suggest cost reductions in national health care spending could amount to the equivalent of $2,500 for a family of four. Many economists are skeptical those savings can be achieved, but even if they are, its not a certainty that every dollar would be passed on to consumers in the form of lower premiums.

THE SPIN: I also believe every American has a right to affordable health care.

THE FACTS: That belief should not be confused with a guarantee of health coverage for all. He makes no such promise. Obama hinted as much in the ad when he said about the problem of the uninsured: I want to start doing something about it. He would mandate coverage for children but not adults. His program is aimed at making insurance more affordable by offering the choice of government-subsidized coverage similar to that in a plan for federal employees and other steps, including requiring larger employers to share costs of insuring workers.

THE SPIN: Ive offered spending cuts above and beyond their cost.

THE FACTS: Independent analysts say both Obama and Republican John McCain would deepen the deficit. The nonpartisan Committee for a Responsible Federal Budget estimates Obamas policy proposals would add a net $428 billion to the deficit over four years and that analysis accepts the savings he claims from spending cuts. The nonpartisan Tax Policy Center, whose other findings have been quoted approvingly by the Obama campaign, says: Both John McCain and Barack Obama have proposed tax plans that would substantially increase the national debt over the next 10 years. The analysis goes on to say: Neither candidates plan would significantly increase economic growth unless offset by spending cuts or tax increases that the campaigns have not specified.

THE SPIN: Heres what Ill do. Cut taxes for every working family making less than $200,000 a year. Give businesses a tax credit for every new employee that they hire right here in the U.S. over the next two years and eliminate tax breaks for companies that ship jobs overseas. Help homeowners who are making a good faith effort to pay their mortgages, by freezing foreclosures for 90 days. And just like after 9-11, well provide low-cost loans to help small businesses pay their workers and keep their doors open.

THE FACTS: His proposals the tax cuts, the low-cost loans, the $15 billion a year he promises for alternative energy, and more cost money, and the country could be facing a record $1 trillion deficit next year. Indeed, Obama recently acknowledged although not in his commercial that: The next president will have to scale back his agenda and some of his proposals.

Obama's tax plan

The Tax Policy Center and the Barack Obama campaign used some sleight of hand this week in Politico. To quote Eric Tolder of the TPC, Most small-business people, like most everyone else, are not really high-income. While this is true, it completely and totally misses the point.

Lets start with the definition of a small business. Most will tell you that small-business income constitutes income derived from sole proprietorships, partnerships and Subchapter S corporations.

The conservative argument (and that of the John McCain campaign) is that Obamas stated plan to raise taxes on households making $250,000 or more in income is a tax increase on small business. The simple answer to this dilemma can be found in the IRS Statistics of Income Bulletin (Table 1.4, for those who are interested). 

So what do the data say?

In 2006 (the latest year available), $706 billion of such income was reported to the Internal Revenue Service. Of this, about half was reported by households in the top marginal income tax rate. Interestingly, two-thirds of this income was reported by households making $250,000 per year or more the very same households that Obama wants to increase taxes on.

The Obama campaign maintains that the number of small-business owners is what's important. Economists know what matters is the tax rate that's applied to the bulk of small-business income. Make no mistake about it: Obama's plan to raise taxes on households making more than $250,000 will raise taxes on most small-business profits in America.

What type of tax rate are we talking about? Currently, S corporations face a top tax rate of 35 percent, while sole proprietors and general partners face a tax rate of 37.9 percent (since theyre responsible for paying both income tax and the Medicare component of the payroll tax).

Under Obama's plan to let the scheduled 2011 tax rate hikes occur, and his plan to raise the self-employment tax on those making more than $250,000, the S corporation rate would rise from 35 percent to 39.6 percent. The sole proprietor and partner rate would rise from 37.9 percent all the way up to a staggering 50.3 percent. Many Democrats in Congress have proposed making all small businesses (including S corporations) pay this 50-plus percent rate. A small business tax rate that high would be the highest marginal rate faced by them in nearly a quarter-century.

One week ago, Joe Wurzelbacher was just another working man living in a modest ranch house near Toledo thinking about how to expand his plumbing business. But when he stopped Senator Barack Obama during a visit to his block this weekend to ask about his taxes, he set himself on a path to being the newest media celebrity and, like other celebrities, found himself under scrutiny.

Turns out that Joe the Plumber, as he became nationally known when Senator John McCain made him a theme at Wednesday nights third and final presidential debate, may run a plumbing business but he is not a licensed plumber. His full name is Samuel J. Wurzelbacher. And he owes a bit in back taxes.

The premise of his question to Mr. Obama about taxes may also be flawed, according to tax analysts.


An official at Local 50 of the plumbers union, based in Toledo, said Mr. Wurzelbacher does not hold a license. He also has never served an apprenticeship and does not belong to the union. (The national plumbers union, the United Association of Plumbers, Steamfitters, and Service Mechanics, endorsed Mr. Obama, it should be noted.)

Hes basically playing games with the world, Thomas Joseph, the locals business manager, said in a telephone interview Thursday morning.

Just five days ago, Mr. Wurzelbacher, 34, lived in anonymity, a single father who worked all day at his plumbing business and came home to fix dinner and help his son with his homework, as he said on national television.

But he became the hero of conservatives and Republicans when he stopped Mr. Obama, who was campaigning on Shrewsbury Street on Sunday, and asked whether he believed in the American dream. Mr. Wurzelbacher said he was concerned about having to pay taxes as he reached a point where he could afford to buy his own plumbing business, one he said would draw income of $250,000 a year.

Im getting ready to buy a company that makes $250,000 to $280,000 a year, he told Mr. Obama during an exchange that was filmed and later showed up on YouTube. Your new tax plan is going to tax me more, isnt it?

That encounter led to New York Post headlines, appearances on the Fox News Channel and interviews with conservative groups, who seized on part of Mr. Obamas reply.

I think that when you spread the wealth around, its good for everybody, Mr. Obama had said.

When Mr. McCain invoked Mr. Wurzelbacher in Wednesdays debate some version of Joe the Plumber was mentioned two dozen times during the 90 minutes as a way to criticize Mr. Obamas tax plan and wealth-sharing argument, Mr. Wurzelbacher suddenly found camera crews outside his home, Katie Couric on the phone, and himself in the full glare of the media spotlight.

Mr. Wurzelbacher did not respond to a message left on his home phone and there was no answer at his plumbing business.

On Thursday, he told the Associated Press that he felt like Britney Spears.

Im kind of like Britney Spears having a headache, he said. Everybody wants to know about it.

Unlike some other states, Ohio does not have a formal statewide licensing system for plumbers. But the city of Toledo and other municipalities do, Mr. Joseph said, and Mr. Wurzelbacher has not met those requirements.

All contractors are licensed, and he does not have a license, either as a contractor or a plumber, the union official said, citing a search of government records. I cant find that hes ever even applied for any kind of apprenticeship, and he has never belonged to local 189 in Columbus, which is what he claims on his Facebook page.

According to public records, Mr. Wurzelbacher has been subject to two liens, each over $1,000, one of which a personal tax lien is still outstanding.

And his question to Mr. Obama about paying taxes? According to some tax analysts, if Mr. Wurzelbachers gross receipts from his business is $250,000 and not his taxable income then he would not have to pay higher taxes under Mr. Obamas plan, and probably would be eligible for a tax cut. Mr. Wurzelbacher is registered to vote in Lucas County under the name Samuel Joseph Worzelbacher.

We have his named spelled W-O, instead of W-U, Linda Howe, executive director of the Lucas County Board of Elections, said in a telephone interview. Handwriting is sometimes hard to read. He has never corrected it in his registration card.

The records, she said, showed he voted Republican in the March primary.

Mr. Wurzelbacher told Ms. Couric that his encounter with Mr. Obama was a matter of impulse.
Neighbors were outside asking him questions, and I didnt think they were asking him tough enough questions, he said.

He went on, You know, Ive always wanted to ask one of these guys a question and really corner them and get them to answer a question, he said, for once instead of tap dancing around it, and unfortunately I asked the question, but I still got a tap dance.

He added, Almost as good as Sammy Davis Jr.

Five days later his decision to confront Mr. Obama has spawned a line of novelty T-shirts sold on the Internet.
